THIS IS AN AGREEMENT BETWEEN YOU OR THE ENTITY THAT YOU REPRESENT (hereinafter “You” or “Your”) AND FAIRDICE TECHNOLOGIES (hereinafter “FairDice”) GOVERNING YOUR USE OF FAIRDICE PRODUCTS AND SERVICES.
You must be of legal age to enter into a binding agreement in order to accept the Terms. If you do not agree to the Terms, do not use any of our Services. You can accept the Terms by checking a checkbox or clicking on a button indicating your acceptance of the terms or by actually using the Services.
We may modify these Terms at any time. If we do so, we’ll let you know either by posting the modified Terms on the Site or through other communications. It’s important that you read the Terms whenever we modify them because if you continue to use the Service after we have posted the modified Terms on the Site, you are indicating that you agree to be bound by the modified Terms. If you don’t agree to be bound by the modified Terms, then you may not use the Service anymore. Because our Service are evolving over time we may change or discontinue all or any part of the Service, at any time and without notice, at our sole discretion.
Subject to this Agreement, we hereby grant to you a limited, terminable, non-exclusive, non-transferable, royalty-free license, to access the FairDice servers (the “Servers”) solely for the purposes of using the Services.
In order to use the Services, you must: (i) agree to this Agreement, (ii) create a valid Account, and (iii) have a suitable connection to the Internet (which is not provided by us) that permits such devices to be connected to the Servers. As the Services will continuously evolve over time, we reserve the right to modify these requirements at our sole discretion.
FairDice charges the fee set forth on the Website for your use of the Services. You hereby agree to all such fees and permit FairDice to charge you for such fees using the payment method you described during your Account registration. Your obligation to pay fees continues through the end of the subscription period during which you cancel your Account.
To use FairDice's Products and Services, you must create an Account by completing the registration process. You will be guided through the registration process when you access the Services on the Website. You must provide us with current, complete and accurate information (including your email address) as prompted by the applicable registration form. You hereby promise that all information that you submit during the registration process is true and accurate.
Personal information you provide to FairDice through the Service is governed by FairDice Privacy Policy. Your election to use the Service indicates your acceptance of the terms of the FairDice Privacy Policy. You are responsible for maintaining confidentiality of your username, password and other sensitive information.
You are responsible for maintaining the confidentiality of your Account username and password. You agree to notify us immediately of any unauthorized use or theft of your account or any other breach of security (and to provide properly documented evidence as reasonably requested by us). We are not responsible for any loss or damage to you or to any third party incurred as a result of any unauthorized access and/or use of your user account, or otherwise.
FairDice may provide sample files and applications for the purpose of demonstrating the possibility of using the Services effectively for specific purposes. The information contained in any such sample files and applications consists of random data. FairDice makes no warranty, either express or implied, as to the accuracy, usefulness, completeness or reliability of the information or the sample files and applications.
FairDice, FairDice logo, the names of individual Services and their logos are trademarks of FAIRDICE TECHNOLOGIES. You agree not to display or use, in any manner, the FairDice trademarks, without FairDice’s prior permission.
YOU EXPRESSLY AGREE THAT THE USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS FOR YOUR USE, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT YOU WILL BE ABLE TO ACCESS OR USE THE SERVICES AT TIMES OR LOCATIONS OF YOUR CHOOSING.
You agree to indemnify and hold harmless FairDice, its officers, directors, employees, suppliers, and affiliates, from and against any losses, damages, fines and expenses (including attorney's fees and costs) arising out of or relating to any claims that you have used the Services in violation of another party's rights, in violation of any law, in violations of any provisions of the Terms, or any other claim related to your use of the Services, except where such use is authorized by FairDice.
These terms and conditions will be construed only in accordance with the laws of India. In respect of all matters/disputes arising out of, in connection with or in relation to these terms and conditions or any other conditions on this website, only the competent Courts at New Delhi, India shall have jurisdiction, to the exclusion of all other courts.
